Shillong, July 9: The Meghalaya High Court has directed the Meghalaya Public Service Commission (MPSC) to conclude the process for regularization of services of Weaving Inspectors in accordance with law.

The order was passed by the bench of Chief Justice Ajay Kumar Mittal on Tuesday while disposing of a writ petition filed by Playstarwell Suting and others.

The petitioners have approached the Court under Article 226 of the Constitution of India seeking regularization of services of Weaving Inspectors in the Office of the Directorate of Sericulture and Weaving Department as approved by the Cabinet vide letter under Memo. No. PER(AR) 76/99/Pt.V/297 dated 27.08.2007.

Challenge is also being made to Memo. No. SW(E)1/2016/86, dated 09-02-2018 issued by the Director, Sericulture and Weaving forwarding the Fresh Draft Advertisement to the MPSC.

During the hearing, counsel for the respondents No 1-9 referred to Annexure 32 submit that in pursuant to the Personnel Department letter No. PER(AR) 76/99/Pt.V/297 Dt. 27-08-2007, the MPSC issued a draft advertisement for regularisation of services along with approved list for special recruitment to the two posts of Weaving Inspector in the scale of pay of Rs. 13,100-330-15410-EB-420-19190-580-25570/- (Pre-Revised) in the office of Directorate of Sericulture and Weaving Department.

Reference was also made to Annexure-33 by the counsel to submit that Under Secretary, Govt. of Meghalaya, Sericulture and Weaving Department had informed the Director, Sericulture and Weaving, that both the petitioners – Playstarwell Suting and Leninggrad S. Marak – have already been approved for regularisation by the Personnel & Administrative Reforms (B) Department in 2007.

In view of the above, no cause of action arises to the petitioners at this stage, the order said. However, a prayer was made that direction may be issued to the MPSC to conclude the process in terms of Draft Advertisement (Annexure 32) within a time bound frame.

“Accordingly, while disposing the writ petition at this stage, the MPSC is directed to conclude the process in pursuance to the Draft Advertisement expeditiously in accordance with law,” the court order said.
